TERMS AND CONDITIONS (“TERMS”)

By accessing or using VerifiedTalent’s online and/or mobile services and websites, including any VerifiedTalent mobile applications and browser extensions or plugins, collectively known as "VerifiedTalent Apps", as well as any software, service, feature, product, program, or other elements provided by or on behalf of VerifiedTalent on or in connection with such services or websites (collectively, the "Site"), you agree to be bound by these Terms of Service ("Agreement"). Please read them carefully.
By using VerifiedTalent, you confirm you have read and understood VerifiedTalent's Terms & Conditions, Privacy Policy and Cookie Policy.
1. Definitions
• "Service" refers to the VerifiedTalent platform, including all related tools and applications.
• "User" means anyone who uses the VerifiedTalent platform, including job seekers and employers.
• "We," "Us," or "Our" means VerifiedTalent.
2. Acceptance of Terms
By accessing our Service, you agree to comply with these Terms and the applicable policies of Indeed. If you do not agree, please do not use our Service.
3. General Terms of Service
Access and Usage
I. License to Use: Your license to use the Site is automatically revoked upon your attempt to use the Site for any purpose other than: (i) individuals searching for employment openings or services/information related to their employment or job search ("Job Seekers"), (ii) individuals and/or organizations seeking information related to hiring or human resources, seeking Job Seekers, or seeking to make available information regarding employment openings on their or others' behalf ("Employers").
II. Independent Contractor: VerifiedTalent acts solely as an independent contractor. We are not an employment agency and do not have authority to act or make employment decisions on behalf of Employers or Job Seekers.
III. Contact Information: If you require assistance when using the Site, VerifiedTalent can be reached at support@verifiedtalent.com.
Content and Accounts
I. User Content: VerifiedTalent may reject, remove, or limit visibility to any user-submitted content. We may disable any account or restrict your ability to use all or parts of the Site for any or no reason without prior notice.
II. Change of Terms: VerifiedTalent reserves the right to change this Agreement at any time by notifying you via any reasonable means, including by posting a revised Agreement through the Site. Your continued access or use of the Site following any changes to this Agreement will constitute your acceptance of such changes.
Specific Terms for Job Seekers
I. Eligibility: Job Seekers must use the Site exclusively for seeking employment opportunities and related services or information.
II. Job Listings: VerifiedTalent does not guarantee the accuracy or legitimacy of any job listings, and it is the responsibility of Job Seekers to verify the same.
Specific Terms for Employers
I. Service Providers: Depending on your location, Employer services may be provided by different regional entities.
II. Usage: Employers may use the Site to post job listings and seek prospective candidates but must comply with all applicable laws and regulations.
Digital Services Act (DSA)
I. Compliance: VerifiedTalent complies with the relevant provisions of the Digital Services Act (DSA).

4. Changes to Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service constitutes acceptance of the revised Terms.
5. User Conduct and Obligations
I.Eligibility
To use our Service, you must be 18 years or older or have parental consent.
II. Account Registration
To access certain features, you must register for an account and provide accurate and up-to-date information.
III.Prohibited Uses
Users agree not to engage in activities that violate any law or the rights of others, including:
• Posting false or misleading information.
• Engaging in unauthorized data collection or hacking.
• Distributing harmful or malicious software.
6. Intellectual Property
All content on our Service, including trademarks and logos, is owned by VerifiedTalent and protected by intellectual property laws. You may not use this content without authorization.
7. Privacy Policy
Please refer to our Privacy Policy to understand how we collect, use, and protect personal data.
8. Payment and Refund Policy
If applicable, fees for using our Service will be clearly outlined at the point of purchase. Refunds are at our discretion and subject to the terms outlined at the time of purchase.
9. Disclaimer of Warranties
VerifiedTalent provides the Service on an "as is" basis. We disclaim all warranties, express or implied, including the accuracy, reliability, or availability of the Service.
10. Limitation of Liability
To the full extent permitted by law, VerifiedTalent shall not be liable for any indirect or consequential damages arising out of the use or inability to use the Service.
11. Indemnification
You agree to indemnify and hold VerifiedTalent harmless from any claims or demands made by any third party due to your use of the Service or violation of these Terms.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts located in Toronto, Ontario, Canada, except as otherwise agreed by the parties or as described in Section 12 below.
13. Dispute Resolution and Binding Arbitration
I. Informal Resolution
Before initiating any arbitration, you agree to first attempt to resolve any dispute informally by contacting us at support@verifiedtalent.com. Most concerns can be quickly resolved in this manner.
II. Binding Arbitration
If the dispute is not resolved within 30 days from the time informal resolution is pursued, either party may initiate binding arbitration. The arbitration will be conducted in accordance with the rules of the Canadian Arbitration Association. The arbitration will take place in Toronto, Ontario, Canada, or another mutually agreed location.
III. No Class Actions
All claims and disputes within the scope of this arbitration agreement must be arbitrated on an individual basis and not on a class or collective basis. Only individual relief is available in arbitration.
14. Termination
We reserve the right to suspend or terminate access to our Service for any reason, including breach of these Terms.
